Seavale Incorporated owns a self storage facility at the site of the old Bomarc Missile site on Highway 11 North.

The court heard that in June of 2014, a visitor came to the site to examine a vehicle that was being stored there.

The rear wheels were close to an opening of the floor and part of the truck extended over the opening.

The court heard that as someone bent down to examine the wheel the person fell into the opening six feet to the concrete floor and died of the injuries suffered.

Seavale pled guilty to failing as an employer to take every precaution reasonable which is contrary to Section 25-2 of the Occupational Health and Safety Act.

The court says the Occupational Health and Safety Act standard applies in this case because workers were exposed to the same hazard.

The company will also pay a surcharge which will see funds go to a government fund to assist victims of crime.
